Changes in The National Court Register Act regarding Polish Classification of Activity for some companies

22-04-2015

Dear All,

Most companies will be submitting their financial statements to the NCR in the coming months. Please remember about the changes in the NCR notification requirements regarding a maximum of 10 principal objects of the company's activity (PKD), including the main one.

The "top 10" objects must be listed in the first application submitted to the NCR after 1st December 2014. Notification doesn't usually require amendment of your company's Articles of Association, but please check first if you are not using an old PKD of 2004.

The new requirements result from the amendment of The National Court Register Act (Act of 26 September 2014) which came into effect on 1 December 2014. Following this amendment, if an application is submitted to the NCR after 1 December 2014, the scope of the company's activity registered in the NCR must be changed to bring it in line with the Polish Classification of Activity (PKD) and a  maximum of 10 principal objects can be reported, including the main one.

For some companies, compliance with the amended requirements will result in having to change the company's activity specified in the Articles of Association by replacing any references contained in the AA to the invalid Polish Classification of Activity of 2004 with references to the valid Polish Classification of Activity of 2007.
