DZP experts publish commentary on Waste Act

The authors of our blog DZP dla Å›rodowiska  (http://srodowisko.dzp.pl/) have published a commentary on the Act on Keeping Municipalities Clean and Tidy ("AKMCT”).

In the commentary they focus on issues relating to the amendments to the AKMCT that came into effect on 6 March 2013. The commentary was published by the Infor Biznes publishing house.
Over around 300 pages our experts comment on the provisions of the AKMCT in the most practical way, discussing the problems faced by players on the municipal waste management market. They refer to the recent amendments and also to controversial issues that have arisen during practical application, in the context of both planning infrastructure investments and organising tenders for waste collection or for waste collection and management.

Some of the issues discussed in the commentary are:
- municipal waste management charges
- rules on running municipal waste management business  
- organisation of tenders
- reporting requirements, inspections, and administrative and criminal liability.

At the start the commentary was published as an insert to Dziennik Gazeta Prawna between November 2012 and February 2013.
"Our commentary has turned out to be extremely popular and the need for a substantive and practical attitude to the numerous doubts that have arisen under the Act on Keeping Municipalities Clean and Tidy continues to be enormous. Thus the idea came about to expand the commentary to cover other provisions, to update it, and to publish it in book form,” says Katarzyna Kuźma, abogada, Partner in DZP's Infrastructure and Energy Practice, and also head of the waste management advisory team and co-author of the commentary.

As far as possible, our experts have taken a clear stance and set out specific proposals for solutions to the problems as the commentary is to be a practical tool for interpreting and applying the provisions of the AKMCT.
