PESEL number necessary for the Register of Pledges

Pursuant to §7 of the decree of October 15, 1997 on the detailed organisation and manner of managing of the Register of Pledges, a motion for making an entry in the register should include identification numbers of the entities to be registered.

This means that if a natural person is to be registered in the Register of Pledges, it is necessary to include the PESEL (national identification) number of that person. This becomes problematic in the case of natural persons who do not have a PESEL number, i.e. mainly those persons who are not Polish citizens.

If the PESEL number is not included in the motion for making an entry in the Register of Pledges, the court will deny the motion and, consequently, the registered pledge will not become effective.
