Will Polish courts be more effective thanks to recording of trials?

12-04-2010

On February 23, the government accepted draft legislation which is to change the Code of Civil Procedure and next it will be discussed by Sejm. The draft will enable to record court actions by means of an electronic minutes to be used in courts recorded in audio or audio-visual version. The audio or audio-visual recording will provide better grounds to judge the collected evidence and instance control than the traditional (written) protocol. This solution may affect the speed of conduct of proceedings in courts and increase the number of examined cases, since the judge will not have to dictate the contents of the protocol to the recorder (as it is the case now). This may result in faster pursue of receivables and rights i.a. by entrepreneurs before courts. The government proposes that the new provisions become binding on July 1, 2010. Equipping court rooms in audio and audio-visual equipment is to take place successively throughout the years 2010-2012.
