Prohibition of merger of PGE and Energa

On January 13, 2011 the President of the Office of Competition and Consumer Protection (UOKiK) issued a decision which prohibits Polska Grupa Energetyczna (PGE) to take-over the company Energa. In the opinion of the UOKiK President, PGE’s take-over of the company Energa would result in limitation of competition on the energy market.  The PGE Group is the biggest producer of electrical energy in Poland. According to the UOKiK President, the merger of the PGE Group, which already has a strong market position, with the company Energa would create an entity which would decide on conditions of sale and dictate energy prices independently of competitors and contractors. The decision is not valid yet. PGE has the right to appeal to the Court of Competition and Consumer Protection in Warsaw.
