On September 24, 2009 the Sejm resolved on an amendment to the Act on Court Fees in Civil Matters. Pursuant to the new wording of Article 28 of the Act, the fees for appeal in a simplified procedure will depend on the value of the subject of appeal. It happens quite often that court judgments are appealed against only partially which results in that the dispute between parties is limited and concerns an amount smaller than originally. Until now, the fee for appeal equalled the fee for suit and in its judgment of December 18, 2008, the Constitutional Tribunal recognised the situation to be contrary to the Constitution.
The Act will come into force 14 days from its announcement.
