Collective proceedings

On January 4, 2010 the President signed an act on pursuing claims in collective proceedings. The act regulates a new separate type of civil court proceedings: the so-called collective proceedings. The proceedings relate to the cases in which a group of at least 10 persons pursues identical claims against one entity. In such a case the statement of claim shall be filed by a so-called representative of the group of consumer advocate.
The new act is to facilitate the collective pursuing of rights i.a. through decreasing the financial and formal burdens on the particular members of the group. From the formal point of view only the representative of the group will be a party to the litigation, even though the judgments are to be effective for all members of such a group. The act will come into force within 6 months from its announcement in the Journal of Laws.
