Pursuant to the Supreme Court resolution of March 16 (court file no. I PZP 2/10), the provision included in Article 411 § 1 of the Labour Code, which excludes employees’ protection against termination or dissolution of employment contracts, applies only in case of declaring bankruptcy with liquidation of assets and does not apply in case of declaring bankruptcy with a possibility to conclude a settlement with creditors.
