New rules of dividend payment

Out of the several changes to the acts relating to taxation it is worth mentioning that since January 1, 2011 new rules apply to taxation of dividends paid by foreign and domestic companies. There have been added further conditions to be fulfilled in order to qualify for tax exemption at source, namely: 1) the company which receives income must not benefit from exemption of its entire income from income tax, irrespective of the source of such income; 2) ownership of shares should generally result from an ownership title. Moreover, parties paying the dividend are obliged to receive from the dividend recipient a statement which would confirm that the entity in question fulfils the conditions of tax exemption.
