Employee may refuse to carry out employer’s order

Pursuant to the Article 100 item 1 of the Labour Code, an employee is obliged to perform work dutifully and diligently and to follow supervisors’ orders which refer to his/her job as long as they are compliant with the law or the employment contract. If an employee suspects that performance of a task might bear hallmarks of a crime, then he/she should notify the police or a public prosecutor’s office. The State Labour Inspection Authority explains more and more often to employees who contact it that in situations as those mentioned above, they are not obliged to follow their supervisors’ orders and, in certain cases, they should notify state authorities. Such a case may be e.g. an order to falsify the “best before” date of foodstuffs.
