From January 1, 2011 the decree of the Ministry of Finance will be binding with regard to cash registers. The decree imposes a duty to use fiscal cash registers for recording provided services by persons of such professions as i.a. a lawyer, doctor, expert, detective or a security guard.
With its judgment of June 23, 2010 (court file no.: I SA/Po 194/10), the Voivodship Administrative Court in Poznań decided that it is rightful to deduct the VAT from invoices received as a result of their printing from PDF files sent by e-mail. In such situation, invoices should be printed and archived as paper copies.
The Ministry of Finance intends that the Act on VAT should restrict the possibility to deduct VAT by entrepreneurs from the beginning of 2011 in case of purchase of cars with partition grille frames, i.e. cars with LCV homologation, of the payload exceeding 500 kg and the permissible maximum mass not exceeding 3.5 tons and in case of purchase of fuel to such cars.
The Ministry of Regional Development has started work on a draft decree relating to public aid granted under the Human Capital Operational Programme.
On July 13, the Government accepted the Assumptions for the Draft State Budget for 2011 which refer i.a. to major macroeconomic indices, i.e. GDP rise of 3.5%, the average remuneration of PLN 3,359, the unemployment rate of 9.9% at the end of the year.
From July 16, 2010, new regulations have been binding which relate to rules of employees’ qualifications improvement. Under Article 1031 § 1 of the Labour Code, professional qualifications improvement is understood as gaining or supplementing knowledge or skills by an employee at the employer’s initiative or with the employer’s consent.
Pursuant to the law, the President of UOKiK may impose penalties up to EUR 50 million on an entrepreneur and up to fifty-fold average remuneration on an individual authorised by the entrepreneur who is being controlled.
An employer will be obliged to pay salary to the employee for his/her justified absence at work of no more than 10 working days as resulting from the employee’s work-time schedule. Should the act be signed, it will come into force on the day of its announcement.
On June 10 this year the Sejm approved draft changes to the Code of Petty Offences which are intended to allow spontaneous and unrestricted use of green areas defined by the local authority bodies for leisure purposes.
From January 1, 2011 the minimum remuneration will be increased from PLN 1,317 up to at least PLN 1,386. The allowance for working at night as well as the minimum compensation for discrimination will also be increased.
From June 16, 2010 anyone can browse on the Internet through the electronic versions of land and mortgage registers stored in the Central Database.

On June 8 the Polish government accepted the draft act as presented by the Minister of Finance on changing the Act on Prices. Now, the draft will be discussed by the Parliament.
The Sejm Commission „Przyjazne PaÅ„stwo” [„Friendly State”] proposes a change to the tax provisions which would cause that a taxpayer would be able to deduct expenses borne for mobile internet.
The new legislation is being drafted to change the Act on Notaries.
On May 24, the Supreme Administrative Court in the increased composition of seven judges settled the legal issue which had been a source of discrepancies in the judgment practice of administrative courts (file no. II FPS 1/10).
On July 1, changes to the Civil Procedure Code are coming into force, which introduce the rule that open court sessions in civil cases will be recorded with sound recording devices or devices recording both picture and sound.
The Ministry of Finance has drafted a decree which allows for a VAT relief.
The Supreme Administrative Court has decided that it is the date when an invoice or a bill has been received and not the date when such invoice or bill was issued which is relevant for calculating the PLN amount of the expense borne in a foreign currency (II FSK 1440/09).
